Summary

Housing Benefit is undoubtedly much more complex and confusing than it has ever been. Staff administering the scheme, must now cope with the increasing and demanding requirements placed upon them, to keep pace with changes in law, guidance, and doping with requests from Tribunal Service and First-tier Judges.

This course has been designed specifically for Housing Benefit Officers, and paralegals, involved in the consideration appeals/disputes, and the preparation of cases likely to progress to First-tier tribunals. The course should also interest advice staff concerned with raising queries and preparing challenges, on behalf of Housing Benefit claimants.

Aims

  • To examine and illustrate, with the use of case examples and group exercises, a number of the key areas of Housing Benefit administration, following a determination, the issue of the decision, and any arising queries or appeals which may flow from these processes
  • To examine the powers of Decision Makers to revise determinations within, and out with, laid down time limits that may reduce the need for cases to end up at First-tier tribunals.

Learning Outcomes

At the end of this course you will better understand:

  • The relevant Primary and Secondary Legislation and Housing Benefit Guidance relating to: queries and disputes and the right of claimant/representatives to seek; more information; reconsideration of claim; appeal; and the time limits applying to each stage.
  • Rights and Powers of Decision Makers to; revise an original decision due to ignorance/mistake of fact, error of law; supersede due to change in circumstances
  • From what date should the revision or supersession take effect?
  • Which decisions are Appealable and Non-Appealable?
  • Timescales that councils must be able to operate within and liaison with Tribunal Service
